These General Conditions of Sale regulate the purchase of products through the website www.mito.it by users qualified as "Consumers" pursuant to Legislative Decree 206/2005 and subsequent amendments (Legislative Decree no. 206/2005).

Acceptance of the General Conditions of Sale

By placing an order according to the methods provided by the Site, the Customer declares that he has read all the information provided and fully accepts these General Conditions of Sale.

Purchase Methods

The Customer can only purchase the products present in the electronic catalogue of the Site at the time of placing the order. The information, images and technical sheets are purely indicative and Mito Srl reserves the right to make changes and/or improvements without the obligation of prior authorisation and without assuming any liability.

Prices and Payment Methods

All prices are expressed in Euros and exclude VAT and transport. Any shipping costs or supplements are specified before the order is confirmed.

Shipping and Delivery

The products will be delivered to the address indicated by the Customer and entrusted to the courier within 5 working days of the order confirmation. Mito Srl is not responsible for delays that are unforeseeable or not attributable to it. At the time of delivery, the Customer is required to check the integrity of the packaging and the products, any anomalies must be immediately contested to the courier.

Right of Withdrawal

Pursuant to Articles 52 and following of the Consumer Code (Legislative Decree 206/2005), the Customer has the right to withdraw from the contract within 14 days of receiving the products, without having to provide any reason, according to the following methods:

Communication of withdrawal: The Customer must inform Mito Srl of the decision to withdraw by means of an explicit declaration to be sent by email to info@mito.it

Return of products: The Customer is required to return the products without undue delay and in any case within 14 days from the date on which he communicated the withdrawal.

  • Transport and return costs: the organisation of transport and the related return costs are borne by the Customer.
  • Product conditions: The Customer is only responsible for the decrease in value of the goods resulting from handling other than that necessary to verify their nature, characteristics and functioning, pursuant to Article 57 of the Consumer Code. The return of the product intact and in the original packaging is required. In the event of improper handling resulting in damage to the product, the refund will be reduced in proportion to the decrease in the value of the goods.
  • Refund: In the event of withdrawal, all payments made by the Customer will be refunded, excluding delivery costs, within 14 days of receiving the notice of withdrawal. The refund will be withheld until receipt of the goods.
  • Exceptions to the right of withdrawal: The right of withdrawal is excluded for contracts concerning the supply of; Products made to measure, customized at the specific request of the Customer or goods that risk rapid deterioration.


Legal Guarantee of Conformity

The products sold are covered by the legal guarantee of conformity provided for by Articles 128-135 of the Consumer Code. In the event of a lack of conformity, the Customer has the right to restore the conformity of the goods by repair or replacement. The organization of transport and shipping costs for the return of the defective product are the responsibility of the Customer, while the costs for the return of the repaired or replaced product are the responsibility of Mito Srl.

Privacy and Processing of Personal Data

The personal data provided by the Customer will be processed in accordance with EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003. For more information, consult the Privacy Policy available on the Website www.mito.it.

Applicable Law and Competent Court

These General Conditions of Sale are governed by Italian law.

By accepting these General Conditions of Sale, the Customer acknowledges and accepts that the competent court for any dispute arising from this contract, stipulated in Italian territory, will be exclusively that of Pesaro.

Changes to the General Conditions of Sale

Mito Srl reserves the right to change these General Conditions of Sale at any time. Any new rules will be effective from the moment of publication on the Site and will apply only to sales concluded subsequently.

Final Clauses

The invalidity or ineffectiveness of one or more clauses of these General Conditions of Sale does not affect the validity of the other clauses.

Failure by Mito Srl to exercise a right does not constitute a waiver to take action against the Customer or to assert its rights.
